License Agreement
This is a legal agreement (this "Agreement") between you ("Licensee") and Obsidium Software ("Licensor"). By downloading the software package and/or by installing and/or using the software, you agree to be bound by the terms of this Agreement.
1. Grant of License
a) Upon download of the evaluation version License Agreement grants you the
following rights:
i) Evaluation Copy
This section shall apply only if the Software has been provided for the Licensee's
evaluation of the Software ("Evaluation Copy"). An Evaluation Copy
is provided "AS IS", with no warranties, express or implied, or maintenance
service; for the sole and exclusive purpose of enabling Licensee to evaluate
the Software. Licensee may not distribute any files processed ("protected")
by this Software.
b) Upon issuance of a valid License Key to you, this License Agreement grants
you the following rights depending on the type of License:
i) Single User License
This License Agreement ("License") permits Licensee to use one copy
of the software package ("Software Package") for its own purposes
only. The Software Package includes software and documentation. This non-exclusive
License, without the right to sublicense, is to install and use the Software
on any single computer that is running a validly licensed operating system.
Neither concurrent use on two or more computers nor use in a local area network
or other network is authorized without the advance written consent of Licensor.
Subject to the foregoing, Licensee may not use the Software in a manner that
allows other users than Licensee to use the Software. Licensee may install a
second copy of the Software for his or her exclusive use on either a home or
portable computer, but may only use one copy at a time. Files processed ("protected")
by the Software may be distributed without limitation.
ii) Company License
This License permits Licensee to use one copy of the Software Package for its
own purposes only, the Software may be used by all employees of Licensee at
facilities governed by Licensee. The Software Package includes software and
documentation. This non-exclusive License, without the right to sublicense,
is to install and use the Software on more than one computer that is running
a validly licensed operating system. Concurrent use on two or more computers
or use in a local area network or other network is authorized without the advance
written consent of Licensor. Subject to the foregoing, Licensee may not use
the Software in a manner that allows other users than Licensee to use the Software.
Files processed ("protected") by the Software may be distributed without
limitation.
2. Term
This License is effective upon Licensee's first use of the Software and shall
continue until terminated. Obsidium Software may terminate this Agreement upon
breach by Licensee of any terms hereof.
3. Other Restrictions
Licensee may not rent, lease or otherwise commercialize the Software in any
manner. Licensee may not reverse engineer, decompile, disassemble or modify
the Software in any way.
The Software may not be used to process programs which
i) are malicious, harmful or fraudulent (including, but not limited to, worms, trojan horses, rootkits, spyware etc.)
ii) are intended for the development, design, manufacture or production of
nuclear, missiles, or chemical or biological weapons
iii) provide, encourage or facilitate unproven or experimental medical advice, diagnoses, cures or treatments
4. Privacy
Protected files may include information derived from Licensee's License Key for the protection
and assertion of Licensor's legal rights.
5. Limitation of Liability
THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS
TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH THE LICENSEE. SHOULD
THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING,
REPAIR OR CORRECTION.
